Terms and Conditions for Collab Ag

1. Introduction

These Terms and Conditions (“Terms”) apply to all consulting services provided by Collab Ag (“we”, “our”, or “us”) to you, the client (“you” or “the Client”). By engaging our services, you agree to be bound by these Terms.

  

2. Scope of Services

We provide professional agricultural consulting services, which may include:

  • Farm data analysis and digital ag solutions
  • Precision agriculture support
  • Farm business planning and strategy
  • Machinery and technology optimisation
  • Staff training and operational advice

All services will be outlined in a written proposal or agreement specific to your engagement.

  

3. Fees and Payment

  • Fees will be set out in our quote or engagement letter.
  • All fees are exclusive of GST unless stated otherwise.
  • Payment terms are strictly 14 days from invoice date.
  • Late payments may incur interest of 2% per month and/or result in paused services.

  

4. Client Responsibilities

You agree to:

  • Provide accurate and timely information and access as reasonably required.
  • Ensure decisions are made with full understanding that final responsibility for      actions taken based on our advice rests with you.

  

5. Confidentiality

Both parties agree to keep confidential all sensitive or proprietary information unless required by law or with written consent.

  

6. Intellectual Property

All materials, reports, and recommendations produced by us remain our intellectual property unless otherwise agreed in writing. You may use them for your internal purposes only.

  

7. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the fees paid for the specific service giving rise to the claim.
  • We are not liable for any indirect, incidental or consequential loss (including lost profits, yield loss, or business interruption).

  

8. Indemnity

You agree to indemnify and hold us harmless against any claims, losses, or expenses arising from the use of our services, unless due to our negligence or misconduct.

  

9. Termination

Either party may terminate the engagement with 14 days’ written notice. Fees for services rendered to date will remain payable.

  

10. Force Majeure

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemics, or equipment failure.

  

11. Governing Law

These Terms are governed by the laws of  Victoria, Australia. Any disputes will be resolved in the courts of that jurisdiction.

  

12. Amendments

We reserve the right to amend these Terms at any time. The latest version will be provided upon request or posted on our website.

Return and Refund Policy

  Refunds and Return Policy

At Collab Ag, we take pride in delivering valuable agricultural consulting services and digital tools to support your operation. This policy outlines how we handle cancellations, refunds, and dissatisfaction—fairly and transparently.

  

1. Services (Consulting, Field Work, Advisory)

We do not offer refunds for change of mind once a consulting service has commenced. However, if you are dissatisfied with the quality or outcome of a service:

  • Contact us within 7 days of service delivery.
  • We may offer a revision, correction, credit, or partial      refund, at our discretion.
  • Full refunds may be considered in exceptional cases where no value was delivered,      and no work was usable.

No refunds will be issued for:

  • Delays caused by client inaction
  • External risks (e.g. weather, machinery downtime)
  • Outcomes influenced by inaccurate or incomplete data provided by the client

  

2. Digital Products (e.g. Reports, Maps, Prescriptions, Data Files)

Due to the nature of digital goods, refunds are only offered if:

  • The file is corrupt, unusable, or not delivered as described
  • You notify us of the issue within 3 business days of delivery
  • We are unable to correct or replace the file promptly

We do not offer refunds for:

  • Change of mind after download
  • Incorrect file use due to third-party software/hardware compatibility
  • Data errors caused by client-supplied information

If you experience an issue, please contact us—we’re here to help resolve it quickly.

  

3. Cancellation Policy

  • You may cancel scheduled consulting sessions with at least 48 hours' notice.
  • Cancellations under 48 hours may incur a cancellation fee to cover time allocated.
  • Project-based engagements may include non-refundable deposits or staged payments once work has commenced, as outlined in your service agreement.
